Article 1 – Definitions In these terms and conditions, the following definitions apply:
Entrepreneur: Meditech Europe, established in the Netherlands, operating under the name Meditech Europe.
Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
Distance contract: A contract whereby, within the framework of a system organized by the entrepreneur for the remote sale of products and/or services, up to and including the conclusion of the contract, exclusive use is made of one or more techniques for remote communication.
Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Cooling-off period: The period within which the consumer can exercise his right of withdrawal.
Day: Calendar day.
Long-term transaction: A distance contract concerning a series of products and/or services, for which the delivery and/or purchase obligation is spread over time.
Durable data carrier: Any means that enables the consumer or entrepreneur to store information that is personally addressed to him, in a way that allows future consultation and unchanged reproduction of the stored information.
Article 2 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and orders between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate before the distance contract is concluded how the general terms and conditions can be viewed at the entrepreneur's premises and that they will be sent to the consumer free of charge as soon as possible upon request.
Article 3 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer.
Every offer contains information that makes it clear to the consumer what rights and obligations are attached to the acceptance of the offer.
Article 4 – The Contract
The contract is concluded, subject to the provisions of paragraph 4, at the moment of acceptance by the consumer of the offer and the fulfillment of the conditions set.
If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm the receipt of the acceptance of the offer electronically.
If the contract is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment.
Article 5 – Right of Withdrawal
The consumer may terminate a contract for the purchase of a product within a cooling-off period of 14 days without stating reasons.
During the cooling-off period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to determine the nature, characteristics, and functioning of the product.
The consumer is only liable for any diminished value of the product resulting from handling the product beyond what is permitted in paragraph 2.
Article 6 – Prices and Shipping Costs
The prices of products or services mentioned in the offer include VAT.
Shipping costs are automatically calculated by the webshop.
If an order requires pallet transport, the actual transport costs will be settled afterward.
Article 7 – Payment
The amounts due by the consumer must be paid within 14 days after the start of the cooling-off period.
If advance payment is agreed upon, the consumer cannot assert any rights regarding the execution of the order before the agreed advance payment has been made.
If the consumer fails to meet his payment obligation on time, the entrepreneur is entitled to charge statutory interest and collection costs.
Article 8 – Returns Procedure
The consumer can return a product within 14 days of receipt, provided it is unused, undamaged, and in the original packaging.
The consumer must contact Meditech Europe customer service to initiate a return request.
The consumer will receive the necessary return instructions and must return the package within 14 days after registration.
Returns are at the consumer’s expense and risk unless the product is defective or incorrectly delivered.
After receiving and inspecting the returned product, the purchase amount will be refunded within 14 days via the original payment method.
The following products cannot be returned:
Products that cannot be returned for hygiene or health reasons and whose seal has been broken after delivery.
Products that have been customized or specifically made to the consumer's specifications.
Products that can spoil quickly or have a limited shelf life.
Digital products that were made available immediately after purchase.
Article 9 – Complaints Procedure
Complaints about the execution of the contract must be submitted within a reasonable period.
The entrepreneur will handle complaints within 14 days of receipt.
If a complaint cannot be resolved within 3 months, a dispute arises that is subject to the dispute settlement procedure.
Article 10 – Disputes
Dutch law exclusively applies to contracts between the entrepreneur and the consumer.
Disputes can be submitted to the Webshop Disputes Committee.
Article 11 – Disclaimers
No rights can be derived from the use of Meditech Europe’s products.
Meditech Europe only provides information about the potential effects of precious metals, gemstones, energy, and frequency usage.
Legal notice: The existence of geopathic stress, electrosmog, and electromagnetic fields is currently not sufficiently scientifically proven or recognized.
